Please note that all K-1 forms have been mailed to all Tri-State Energy Group investors.
In addition, on April 6, 2012, the Receiver filed his Fifth Report and Agreed Motion to Wind Down the Receivership. As set forth in the Receiver's report, the Receiver has distributed nearly $1,160,000 to defrauded investors.
On November 21, 2006, the United States Securities and Exchange Commission filed its complaint against Mercer Capital, Inc., Mercer Capital Management, Inc., Tri-State Energy Group, LLC, Tri-State Energy Group I, Ltd., and Tri-State Energy Group II, Ltd., alleging that these entities along with Robert Flickinger had engaged, and were engaging in, violations of the federal securities laws. After reviewing the SEC's submission, Judge Donald Middlebrooks of the United States District Court for the Southern District of Florida entered a Temporary Restraining Order, Freezing Assets and Appointing Receiver over Mercer Capital, Inc., Mercer Capital Management, Inc., Tri-State Energy Group, LLC, Tri-State Energy Group I, Ltd., and Tri-State Energy Group II, Ltd. The Temporary Restraining Order also applies to Defendant Robert Flickinger. On December 12, 2006, a Preliminary Injunction was entered against the Defendants.
Pursuant to the Federal Court Order, Daniel S. Newman, Esq. has been appointed Receiver by the Court over Mercer Capital, Inc., Mercer Capital Management, Inc., Tri-State Energy Group, LLC, Tri-State Energy Group I, Ltd., Tri-State Energy Group II, Ltd. and Mercer Asset Management LLC, collectively the "Entities." By Order dated December 10, 2008, Mercer Asset Management, LLC was removed from the receivership.
